State’s Obligations
1) The respective governments must immediately impose sanctions by using their leverage to halt the export, sale, and transfer of aviation fuel to Myanmar by international companies.
2) International Governments, especially the UK Government, must prohibit the provision of marine insurance services to vessels and infrastructure (ports, storage tanks, or pipelines) involved in the delivery of aviation fuel to Myanmar.
3) International governments must immediately impose sanctions on the Myanma Petrochemical Enterprise (MPE), which is controlled by the Myanmar military junta and the pivot of the aviation fuel supply chain to the country.
4) United Nations Member States—including the United States, United Kingdom, Australia, Canada, the European Union, ASEAN Member States, China, and India—are responsible for implementing UN Human Rights Council (UNHRC) Resolution A/HRC/RES/55/20, passed in April 2024, which urges the cessation of the export, sale, and transfer of aviation fuel to Myanmar.
5) Despite existing sanctions on domestic aviation fuel firms by the EU, US, UK, and Canada, these governments must extend their oversight to track, monitor, and investigate international corporations, intermediary brokers, individuals, and entities that continue to supply aviation fuel to Myanmar, ensuring that effective action is taken against them.
6) To halt the Myanmar military’s aviation fuel supply chain, international governments, including the European Union (EU), ASEAN, the US, and the UK — must collaborate with civil society to monitor shipping routes and fuel storage facilities. Furthermore, fuel transfers must be stopped immediately through the strict verification of End-user Certification.
7) It is imperative to take effective measures against the Chinese-flagged ship HUITONG 78, Vietnamese petroleum storage terminal operator Hai Linh Co. Ltd, Chinese state-owned entity (SOE) CNOOC Trading (Singapore) Pte. Ltd. and Singapore-based Sahara Energy, as well as all other international entities complicit in the military junta’s aviation fuel supply chain, which facilitates war crimes.
